Legal Question in Employment Law in Florida
At-will state
I have worked for a company for 9 years and was recently terminated. I have never been written up or have had any problems in the past.I realize that Florida is an at-will state, but does company policies play a part in if I can be fired without any kind of notice or any past problems.Being a manager for this company I know that company policy to be fired you have to be written up or have had some type of verbal warning.I honestly believe I was fired because the new manger that I was transferred over to did not like me. Is there anyway to prove discrimination? Also is it normal to recieve a severance pack. while being fired?

It is not illegal to fire someone simply because you do not like them. Simply put, there is no law against a company acting like a jerk. Still, if they did not like you because of your age, race, religion or national origin, then there would be a violation of the law. These are difficult cases to prove, put if you can eliminate any resonable cause for the firing and the boss had made statements indicating bias or only employees of a certain race, age, religion or national origin are being fired, you may want to talk to an employment attorney about your situation.

At-will means just that unfortunately--no notice or policy must be provided or followed. And it is common to receive a severance package. However, if you'd like the package to reviewed by an attorney, please feel free to contact me at (305) 810-2887.
