Legal Question in Employment Law in Florida
Bilinugal requirement
Would it be considered a discriminatory practice to require a director of human resources to be bilingual in spanish in a South Florida regional office while not requiring a director of operations to be bilingual in the same region and business unit? Both individuals interact with the same population of people. Thank you.

Re: Bilinugal requirement
Requiring a second language in a market that justifies it, such as South Florida, should not be considered discriminatory. But it seems that you are asking a different question. What I believe that you are saying is that the company is treating the director of human resources differently than the director of operations. Assuming that the individuals in both jobs are of a different "class" for purposes of discrimination laws, in my view, this factor, alone, may not be sufficient to set forth a case for disparate treatement. But if there is more, or you want to discuss this further, feel free to e-mail me privately at [email protected].
