Legal Question in Employment Law in Florida
Bonus & Paid Time Off
My current position has a quarterly bonus program. I have achieved all of the criteria to receive this bonus. My question is this: I gave my 2 weeks notice last week and I know they are not going to want to give me the bonus that I worked very hard for and achieved. Am I legally entitled?
Also, we start to accrue paid time off after 90 days and can use it after 6 months. They say that unless you work at least 2 years you are not eligible to be paid for this time you accrued, nor would they let you use it before you left. Am I legally entitled?

Re: Bonus & Paid Time Off
There are no black and white answers to either question. You need to check the employee manual, if there is any, to see what it says. If there is no manual or no language in it that is applicable, you have contractual arguments that you did the work and should receive what you bargained for - both the bonus and vacation time.
Unfortunately, Florida law is skimpy when it comes to wage and hour issues, so there is no particular statute which helps.
In the end result, if you can't reach an agreement with the employer, you can hire an attorney to negotiate for you and/or sue. Of course, that costs money.
Please call if you want to review the matter and discuss your options. The consultation is free.
