Breach of non-compete

My boss did'nt pay me all commissions earned in my final check and we have a contract that does NOT say he is allowed to keep it. Even if I sue him and get the money eventually, isnt he still in breach of the contract, therefore the non-compete will be invalid? Can I get my money AND get out of the non-compete?

Probably not, but it would depend on what the agreement says. Usually, the breah of the last check payment would not allow you to ignore the noncompete.
