Legal Question in Employment Law in Florida

Can a broker put a stop payment on a commission?

I was paid 3 commission checks and then resigned later that day. I deposited my commission checks in the bank and then I received a letter from my broker stating that she had put a stop payment on my checks. Is this legal for a real estate broker to do something like this for no reason?

If it was an earned commission, which it appears to have been if you already deposited the checks, you have a cause of action against the broker. Depending upon the value of the checks, you may be able to file a small claims action. You also might consider retaining an attorney. If you are successful in obtaining the unpaid wages you can ask the judge to make the broker pay your attorney fees and costs.
