Legal Question in Employment Law in Florida

Cendant lays off hundreds of employees while President of company tells us all i

Over 350 agents of Progeny were let go along with all support staff in mar. Progeny is owned by Cendant. Company sold long term care plans for 12 years. Over past twoyears they doubled sales staff. Most of hires were not there long enough to get their renewals vested. Need $350,000 in business for this. Company closes before they can get vested. Company not sold. Renewals kept by Cendant. this is Huge accounts recievalbes. They terminated training staff in Nashville but told field managers to keep interviewing and hire. New hires wasted months in training and no pay. This is commission business and then told they were laid off. Feel this was their intention for over a year. Mislead by voice mail, memos, and management. President of Progeny solicits all agents to join his new firm an an independent agent and get vested right away. Seems like a conflict of interest. They told us company was not for sale but it was, but Cendant made the deal so bad that there were no buyers. they wanted to sell the agents and leased building but keep all renewals for themselves. Made the sale undoable. We need to know if we have a case for a class action lawsuit. We are compiling all needed info and documents now.

The main potential claim I could see is whether the commissions were earned under Florida law. If so, they constitute earned but unpaid wages. Would need more facts to advise. Please feel free to contact me at (305) 810-2887 for further assistance.
