Legal Question in Employment Law in Florida
charge back on commission
I work for a Fl company on a commission basis. I am not reimbursed for using my auto, gas or phone. My employer is charging me 1.5% on any missed or added (unknown to me) items. I recently received a breakdown advising me that I owe the company several hundred dollars over any commissioned earned. That means I am paying from commissions earned on other jobs. I am not the only sales rep this is happening to & I feel there must be some law against the company charging me more than they would charge retail to a customer. I would apprieciate any advise.

It is unclear as to whether you are working within an employment contract. If this is a straight-commission charge, it would appear that you could be charged back against commission for things which are unknown to you. I would put together your commission and charge back documentation and consult with an attorney in your area.

Federal law requires employers to pay minumum wage to all employees including commissioned sales people. Additionally, there should be some agreement relating to the 1.5% interest. Finally, there needs to be accountability for the deductions. You should contact a lawyer immediately and provide the lawyer with detailed information relating to the issues you have outlined.
