If someone gives you a check and notes it as final payment when they still owe you more and you deposit it are you accepting it as final payment and legally aren't obligated to get paid the rest?

Yes. Employees cannot waive wages but under certain circumstances ( i.e. Department of Labor agreement or lawsuit). Signing and cashing a check does not make it true that the employer does not owe you any money. An employee has to sign an agreement that specifically addresses unpaid wages laws.
