Legal Question in Employment Law in Florida
Can I collect unemployment?
There was an HR investigation at my workplace and in a statement that I wrote, I asked them if they could hurry the process because I was planning to put in my two weeks notice. A couple days later I was called into work and asked to turn in my keys. I was told that I should try to collect unemployment because I feel like I was fired by being called on my day off and them taking my keys. Is there any way that I could collect unemployment? I didn't think I could because the company says that I quit.
Also, another employee has filed for unemployment and the corporation has refused to pay, but will not turn over the documents that the state has requested. Will this hurt my case if I can file for unemployment?

Re: Can I collect unemployment?
If an employees quits they are not normally eligible for unemployment. In your case it appears you were fired before you had a chance to quit. I do not know all the facts, and I am not an unemployment hearing examiner, but I would think there is possibility your would get unemployment benefits. Was the statement you gave a letter of resignation or were you just blowing off steam? Were you promising to resign as soon as possible or was it some vague threat to resign at some point in the future?
