Legal Question in Employment Law in Florida

No compete clause

I worked for a company that was bought by a second company in jan 2007. Shortly after that, the new company gave the employees, at 4pm on a Friday, a no compete clause to sign, demanding it be returned immediately the following Monday, which I did (I was not inclined to sign, but who wants to get on the bad side of their new employer?). I was laid off on 12/19/08, with a severance that referenced that clause. Under duress, I signed the severance. Now, I have a job offer from a competitor of my former employer. Is this clause enforceable in Florida?

Re: No compete clause

Unfortunately, you care caught up in a very complicated area of law. It is difficult to tell whether the non-compete clause is enforceable without reading it, as well as the severance you signed.

Regardless of whether it is enforceable or not, you have options. I would welcome the opportunity to discuss those options with you. Please feel free to contact me. Our initial consultations are always free.
