Legal Question in Employment Law in Florida

I have no contract stating the time frame in which I get paid other than on a commission basis, I get paid monthly. Florida law states a patient has 30 days to make a return. Generally I am paid after I have delivered the instrument the next pay period after the first of the month. I understand that he wants to wait until the 30 days is up which some of my patients have already passed and he owes me. I quit on payday and he refused to give me my check and said he will hold it for 60 days which I have already waited 30 days so it will be a total of 90 days. Is this legal?
