Legal Question in Employment Law in Florida

Criminal Negligence or Not

I am a federal law enforcement officer.Off-duty, I locked my duty weapon in a locked handgun box, placed it in locked center console, locked the doors to my vehicle and went inside my residence. Overnight my vehicle was burglarized and my weapon was stolen. There is no known departmental policy prohibiting this. My supervisor told me I was guilty of Criminal Negligence. Is this so and do you think I can legally be terminated.

Note: My employment history has been outstanding.

Re: Criminal Negligence or Not

First, if you are a member of a union, then the issue is whether your employer has "just cause" to terminate you based on the information which you've provided. However, if you are not a member of a Union, and if you are not similarly protected by a civil service rule requiring just cause for termination, then you can be fired for any reason, at any time. Thus, the answer depends on a variety of factors.
