Demand For Performance

This is for my wife who is a Nurse from India.we immigrated from india recently and our paper work was processed by a agency in Tampa.According to their employment agreement they had promised job in philadelphia Their E750 and I140 shows they had submitted the forms showing hospital in philadelphia.we got our immigrant visas and before our arrival agency told place of work would be pittsburg and by then we had made all travel arrangements to US.Now the agency has threathned us with a lawsuit to work in pittsburg or to pay $21000 which is their loss pay which can be paid over a period of 3yrs.we had signed the agreement in india and havent signed any agreement in USA and contract is for 3yrs.The reason for choosing philadelphia was my parents live here.we have replied to their attorney and waiting for their reply.in the mean time can she apply for jobs and start working.please suggest what we should do to resolve the situation.The base is that we signed the contract only after the agency promised placement in philadelphia.we have their mails of promising placement in philadelphia.The contract was signed on 18th Oct 2002 and the mails were sent on 10 oct 2002.please suggest what can be done and how we can go about.

From what you're saying, you may have an action against the agency for breach of contract. You should have an attorney talk with their attorney, you shouldn't really do it yourself.
