Legal Question in Employment Law in Florida

Deposit reimbursement

I recently left a company where I was a car salesan for two+ years. I had given a $200 deposit for my phone and they automatically took out $5 per car that I sold from my pay for a ''Christmas Bonus''. I was payed strictly on commission while I worked there. I returned the phone and any other materials belonging to the dealership when I left and am now in an entirely different field. I had no authority when it came to pricing and final decisions on the delivery cars, I strictly handled the paperwork and actual shipping or delivery of the vehicles. I sold a Viper two months ago and was paid my commissions, and sold the car that was traded in on the Viper, a Porsche, last month and again was paid my commissions. Apparently now, they are having trouble getting the title from the previous lien holder because of a payoff dispute. The proper form allowing the dealership to be protected was never signed and they are currently trying to figure out what to do. In the mean time, they will not release my $200 phone deposit or my Christmas money (approx. $475). Is there any way that I can get my money back from them, as it does not pertain to any commission schedule?

Re: Deposit reimbursement

You could have an attorney write a letter requesting your deposit, but it will likely be a crap shoot as to whether they respond.
