What determines the difference between an employee and an independent contractor? What can and can not an employer ask you to do as an independent contractor as opposed to an employee?

The test can be complex and really depends on the specific facts. Generally, however, an employer has control over the details of what the employee does (what time to be there, how to do the job, what to do, the tools to use) and an independent contractor is given a job and how he accomplished that job is up to him.
