Legal Question in Employment Law in Florida

discrimination

Would it be called discrimination if I'm going to school to be a probation officer and I marry someone that is incarcerated and will a company look at my husbands background and not hire me because of what he has done?

Re: discrimination

Florida law prohibits discrimination based on someone's marital status meaning that an employer cannot treated a married employee different than an employee who is unmarried simply because of the marriage. However, I don't believe it would be illegal (i.e., it is legal) for the employer not to hire you because of your spouse's criminal background.
