Last week, my mother had a heart attack. She will need care for a few weeks while she recovers. I informed work of the details and asked for the FMLA so that I would be protected. They agreed, however, they will not pay me. This would be okay, however, I have knowledge that other employees have been paid (without having accrued time, etc.) When asked, my HR person replied that each employee is treated based on their 'individual circumstance'. This does not seem fair to me, especially since I have tenure over the other employees. Aren't all employees required to be treated equally? Do I have any recourse?

What you describe doesn't sound fair to me either. The real question is, are their actions illegal? I wonder what the "individual circumstances" they talk about are. If this benefit is being denied to you on the basis of your race, religion, age, national origin or gender, then your employer may be in violation of the law. Is there any pattern to their decisions that would give you insight as what the employers actual reasons for this denial of benefits are?
