Legal Question in Employment Law in Florida
Right to due process
Coworkers accusing of several wrongdoings. Personnel director called in without knowledge of what for. Asked accusatory questions & answered truthfully. Supervisor & director of division was not informed. I was threatened with demotion or termination if I wouldn't voluntarily take demotion. In fear of losing job I sent notice of voluntary demotion. My director did not want this. Personnel director now saying I lose seniority and have to take weekend work. He will not give me anything in writing as to our agreement. keeps adding to his punishment. I had no right to due process to improve myself, no representation & now keep getting punished more. What can I do to rectify this?

Re: Right to due process
If you are not a member of a Union and work in the private sector, you do not have any right to "due process." Rather, you are employed at the will of your employer and can be fired or demoted for a good reason, bad reason, or no reason at all--at anytime. Of course, if the action is being taken against you because of your race, religion, national origin, age (if over 40), gender or disability, then the conduct is illegal.
