Legal Question in Employment Law in Florida
Employee rights
My wife has worked as a clerk in a large, national, retail establishment for almost 20 years. Recently, a customer acted irrationally and complained about her. The complaint was unfounded and the first in her long career. However, she has since had to answer many questions of several managers regarding the incident and was recently asked to write a statement about what happened and sign it. The customer continues to return to the store and stares at my wife, making statements to her friends and pointing. This makes work uncomfortable for my wife and she fears walking to her car. Does she have recourse and can she request that all reference to the incident be removed from her file?

Re: Employee rights
There are no "defined" or express rights in this situation, but your wife should send a written complaint to HR and/or her supervisor and should also consider filing a police report if she is scared for her physical safety--this sounds like borderline stalking, which is of course illegal. If your wife still has further concerns, please feel free to contact us at (305) 755-9441.
