Legal Question in Employment Law in Florida

Employer is denying unemployment claim

While I was out on workman's comp., my co. considered it FMLA. I came back on light duty & was let go 1 week later informing me they would not accommodate further. I then received a letter from my employer stating my FMLA benefits are over & I would be receiving COBRA, which I am now on. I have filed for unemployment & was just informed by unemployment that the employer has denied my claim - they said I quit. I have no money coming in & was told unemployment won't even look into for 4 wks. What do I do?

Re: Employer is denying unemployment claim

You need to file a Notice of Appeal within 20 days of the determination denying your claim. You will then be given an appeal hearing and can go and challenge the denial of your benefits. Additionally, how long were you out on leave and what accomodation did you require. Please feel free to contact me at (305) 810-2887 for further assistance.
