Legal Question in Employment Law in Florida
Employer mis-represents insurance
I purchased disability insurance through my employer and they changed the policy terms and conditions without notification. This change caused a loss of income. When I spoke with Human Resources, they said that it was a surprise to them to and that nobody reads that stuff! Is my employer liable for mis-representing insurance policies and what are their limits of liability?

Re: Employer mis-represents insurance
Tough call. If there was a material change, there should have been an amendment of or supplement to the "Summary Plan Description." Whether this was in fact done is unclear, but the federal law governing such claims, the Employee Retirement Income Security Act (ERISA), is complex and not necessarily employee friendly.
