Legal Question in Employment Law in Florida
Employer not paying agreed wage
I live in South Florida. I worked for one week at a store that was to pay me an agreed upon commission for sales. They would not allow me to have copies of the orders I wrote while there. At the end of the first week we were paid and they only paid me 50% of the commissions due based upon the $10,000+ of billed dollars on the invoices. They stated that they had to make all kinds of 'adjustments' to each order to reflect inventory costs and other made up excuses. Things they did not state at the time of hire. They also claimed there were less invoices than my records stated (but of course they don't give copies of the invoice to us to prove what we are owed). They adjusted commissions on a per sale basic based on arbitraty statements and stated that commissions were reduced on 'sale' items regardless of the fact these items had tagged prices that they were sold for. The turnover rate at this store is enormous and this explains why. No one is willing to work more than a week for them with this practice.
What department in Florida can I turn to in order to recover my money? They know that the money due is small compared to the fee for an attorney so they do this with the feeling that they will get away with it.

Re: Employer not paying agreed wage
The answer to your question depends on many factors, including whether or not you are an employee, rather than a contractor, and whether or not you made at least minimum wage and applicable overtime. However, even assuming that there is not an agency that can help you, you may still have a claim in small claims court. I suggest you consult with an attorney.
