Employer pressure for presidential election

The company I work for is privately -held and run by the CEO and Founder as well as the President. The CEO has stated to several people that if Obama is elected it will increase his taxes which may cause him to have to layoff employees. He has said to several people within our company that those that vote for Obama will be on the top of the list for layoffs. Is this legal?
