Legal Question in Employment Law in Florida
Employer tells Employees, Starting Mon. no one is to leave for a lunch Break
Hello, On Fri. Feb. 11th. We received a memo at our store location that starting mon. Feb 14th. we will no longer be able to leave for a lunch break. We have to bring our lunch or order in. We work by ourselves anyway for 10 hr. shifts. Which means that if a customer, comes in we have to put our lunch aside and assist the customer. We get no real break as it is now, but now it is mandatory that no one leave the store for any reason. My question is this. Can they do this, and if not, what is the law requirements, such as for every 8 hrs scheduled to work you get a half hour lunch break. etc.

Re: Employer tells Employees, Starting Mon. no one is to leave for a lunch Break
Yes, it is legal for an employer to require an employee not leave for a lunch break and to be available for work during that "break" time. However, in most cases that employer will then have to pay the employee for that "break" time. It becomes a working paid lunch. There are some exceptions to this answer under the Fair Labor Standards Act, send me an e-mail, [email protected], if you need more details.
