Legal Question in Employment Law in Florida

I'm a loan processor for a mortgage brokerage and work as an independent contractor as does everyone else with the company. The owners of the company are both men and feel the need to make vulgar comments everytime a woman calls, walks in, or just walks by. In addition, the two of them yell foul language back and forth across the building. My desk is in the middle of it all. They are under the impression that they don't have to worry about sexual harrassment laws because everyone is an independent contractor. Is this true?

There mere classification of someone as an "independent contractor" is not controlling. Rather, the nature of the work relationship, the degree of control of the company of your work schedule, job duties, and a number of other factors would be looked at by a Court. You should make a formal complaint, either in writing and/or through whatever anti-discrimination procedure you might be able to find at the Company. You can also contact an attorney for specific guidance and representation.
