Legal Question in Employment Law in Florida

employment reference legalities

I recently gave my 2 week notice and I have not been able to find a job in about a month. So i had a friend call my last manager and get a fake reference to see what they were saying about me. The comments made back told me why i have not been able to get a job. What can i do legally to this employer for bad mouthing me to future employers?

Re: employment reference legalities

You don't have too many legal options unfortunately. Under Florida law, employers are now allowed to give out negative employment references as long as what they are saying is not "knowingly false." The practical option is to hire a lawyer who can, for a small fee, send the employer a "cease and desist" letter directing the employer to stop giving out the reference or else face litigation. However, there is obviously no guarantee that the employer will honor the "request."
