Employment threatened by a background check error

I am a 59 yr old Afircan-American man, recently employed as a chef in a Nursing Home.After over 1 month of employment( and being told by my manager that my background check was PERFECT!) ) I was told to ''go home'' today because another check had found a conviction in Florida, in 1992.

This is absolutely WRONG!

I was MISTAKENLY arrested in Florida, but the case did not even go to court. As well,I have no personal records of that time, because Hurricane Andrew destroyed everything I owned.

Other than parking tickets, I have a spotless personal record.

I am being wrongly accused of something that did not even happen. I really need this job,and I do not know what to do.

Any and all suggestions would be welcome.

Since you do not currently work in Florida, I cannot provide you with a definitive answer. Under Florida law, however, your situation, although seemingly unfair, would not be illegal because Florida is an employment at-will state, which means that an employer is free to hire, fire, promote, etc., for any reason at any time--including a good reason, a bad reason, or no reason at all.
