Equal Compensation
Can a company hire a new employee, have a 5 year female emplyee train her, then give her the veterans job and pay her more money? The 5 year employee was not discharged and is expected to help the new employee along with newly assigned duties. New employee is younger.

It would be illegal to base pay rates on race, religion, gender, national origin or disability. If employees are being paid less because they are over 40 years old, that to could be illegal. That said, employers are otherwise free to pay employees what ever they want to. In general it is not illegal for an employer to pay a new employee more than is paid to an employee who has worked for them for 5 years. It may be foolish and do little for morale, but it is not itself illegal.
