Legal Question in Employment Law in Florida

Exempt Employees Required to Work a Specific Amount of Hours

Can exempt employees be required to work a specific amount of hours? For example, rather than requiring exempt employees to complete certain additional tasks, can you require them to specifically work 50 hours per week when they have always worked an average of 40+ based on however many hours it happened to take them to complete the job. Then can you ask them to provide you with a record of how many hours worked?

Re: Exempt Employees Required to Work a Specific Amount of Hours

It would not be illegal for an employer to have exempt employees work 50 hours a week. However, where the employer is requiring 50 hours of work I would question whether the employee is correctly classified as exempt. I suggest you speak with an attorney and discuss if, based on your specific job duties, you are correctly classified as exempt.
