Legal Question in Employment Law in Florida

Exempt and overtime payments?

If I am classified by my employer as an exempt employee but I do not hire or fire anybody as part of my position, can I be required to work over 40 hours per week and not compensated for it? And can I be asked to make up time if I come in late as a result of having a doctor's appointment? I work in Human Resources and it seems to me that based on these things I probably should not be classified as exempt and I am getting taken advantage of. Lately, all that is focused on is how many hours we are putting in and if we are not putting in excess of 40 hours per week then we are not doing our jobs successfully.

Re: Exempt and overtime payments?

Your clasiffication could be--aside from any partial day deductions from your salary--improper . . . but based upon the information provided, I believe that if your employer is making deductions from your salary for partial day absences, etc., that may destroy any exemption anyway. Please consult with an attorney immediately to learn more about your rights and please feel free to contact us for further assistance.
