Legal Question in Employment Law in Florida
Failure to pay Overtime
I've heard that ''an employer cannot change a schedule to avoid the payment of overtime''. My employer constantly sends us home early only if we incur O/T. This allows the agency to practice a ''zero O/T'' policy. I think it's a violation of FLRA Rules. The employer will also call you at home to tell you to ''come in late'' in order to ''adjust out'' any O/T as they claim a zero O/T policy. When they can't adjust u out, they do have to pay O/T. Am I(are we) entitled to back pay & damages?
