fell outside / no overtime paid?

I work in a Preschool..while outside fell on playground..hurt foot and top of foot..pulled all ligements and tore some cartilge..owner not filing a worker comps. just paying for it what happens if it never heals and if you work 40 hrs a week is it a law to pay time and half, for anything over 40?
