Legal Question in Employment Law in Florida
Can I get fired for refusing to break the law
I make phone calls to businesses in my work - asking them questions about their products. We have a warning on our phone system that calls may be monitored for training but that's on incoming calls....these are outgoing.
My manager wants me to record the phone conversations I make for the sake of ''training'' without asking the permission of the person that I'm talking to that I'm doing it (because he's certain that they'll say no).
I don't want to do this because I know it's against the law in Florida to tape a phone conversation without the other's permission (and that might even apply to states without this specific a law - that that state can apply our law in their state).
I've told them I have no problem recording my voice or making the recordings if the other person agrees.
Can they fire me if I refuse to do it? If not and they fire me anyway, do I have any recourse?

Re: Can I get fired for refusing to break the law
They should not be able to terminate your employment under the circumstances you've described. However, it may be helpful to document your refusal to participate in this conduct in writing to upper management and request assistance. Finally, please consult an attorney if any action is taken against you and feel free to contact us directly in this regard.
