Fired for testifying

My husband was subpoenaed to testify against his employer in December, 2002 in a case involving an African American ex employee who was fired and now has opened up a similar company and is under a non-compete contract, my husband had previous knowledge of racism within the company, and testified to it. His boss has not spoken to him since then and has put him on a different project and is now going to get rid of the project and fire my husband. Do we need an attorney?

It is illegal for an employer to take a negative employment action against someone because of their race. Likewise it is illegal for an employer to treat an employee of any race badly because that employee objects to what the employee sees a violation of federal anti-discrimination laws by the employer. You may want to review the EEOC web-site at www.eeoc.gov and specifically look for information on retaliation. I suggest you discuss your situation with an attorney.
