Legal Question in Employment Law in Florida

Guaranteed Monthly Bonus Not Paid

Upon hire to the company (that I ended employment with on 6/28/05) I signed ''offer letter'' that stated my base pay plus a guaraneed monthly bonus as my compensation package. The HR Manager and I both signed the form. Bonuses are paid on the 15th of the month for the previous month. I did not get the check. I called and spoke to the HR Manager and was told that she did not know if I was going to be paid the bonus. And that the Operations Manager (who has nothing to do with payroll) would make the decision. Firstly, am I entitled to a copy of my personel file? and Secondly, can I take them to small claims court for not paying me a contracted wage we had both agreed upon when I was hired?

Thank you for your time.

Re: Guaranteed Monthly Bonus Not Paid

the signed documents don't have enforceability as a contract under FLorida law unless there is specified a definite term of employment. However, you can file a small claims case for any earned but unpaid wages.
