Legal Question in Employment Law in Florida

harassment over weight

Hello,I have been told recently i could be fired because of my weight.I have talked with others about having a union come in,to have a voice(CWA)Somehow the plant manager feels i played a part, maybe even beleives iam the kingpin organizer towards bringing in a labor union.Adelphia, the scandal plauged chapter 11 company whom founding family stole billions is my employer in Orlando,Fl I was suddenly told by supervisor and plant manager after they asked me to stand on a scale used for ups packages at our warehouse, that i was over the 280 weight limit in job description as a cable tv technician.I hired on 8 years ago at same weight over 300.This plant manager is trying to stop union efforts badly and will go as low as possible. He is doing this to stop me from wanting a union.I was reassigned a different neighborhood and told no ladder ,underground cable tv plant only.I was told i have 2 months to come down to 280 lbs.Every thursday the manager parades me over to are warehouse in front of co-workers to this scale and he checks my weight. This makes me feel so bad.I'm afraid they will fire me,its embarassing too.I have signed a union card prior to this happening.

Re: harassment over weight

Focus on your union activity. This is protected by law--and unfortunately "weight harassment" is not. Accordingly, you could file what's called an "unfair labor practice charge" with the National Labor Relations Board if you so choose. Please feel free to contact me at (305) 810-2887 and also tell the CWA organizers that you want to file a charge--they will help you for no cost.
