Legal Question in Employment Law in Florida
Harrassment on light duty
I have been on light duty due to a shoulder injury since early april. I am an airline worker at the airport The past week I have been in pain about 75% of the time I am at work so I spend the mahjority of my time in the terminal.I am always at my workplace(The Airport) until quitting time.
Well today I get called down to the office and was told by my union rep .that since I wasn't in my work area when the supervisor called down there it was falsely assumed I left for the day, they were threatening my job is what the union rep was informing of, he used the term ''they were gunning for me''.
I know it was a fellow employee who told the supervisor this as where I work a lot of this goes on. He took this employees word that I left. This was a false assumption and accusation as I was seen by other fellow employess throught out the day and even at the end of my shift. I wrote a statement of my whereabouts. Now I must be in the supervisors view at all time so he can give me supposed work I can do.
1. Do I have any recourse for this false assumption that I left work early and am being harrassed?
2.Can I refuse work if I have pain in my shoulder at all times if i feel the work they give me will worsen my pain and my condition?

Re: Harrassment on light duty
The answer to your questions is first and foremost governed by your Union contract. Accordingly, in order for me to give you advice, I'll need to refer to that contract. Additionally, you should immediately notify your Union rep or local shop steward of the situation and ask them to file a grievance on your behalf.
