Legal Question in Employment Law in Florida

I am a housekeeper at an assisted living facility. My termination reason was refusal of steam cleaning a carpet. As we have a maintenance person and a carpet cleaner in the facility who were both present at the time of the incident, I did not feel that I should have been the one to push a machine around that has a handle that you have to get on your hands and knees to use as I am 8 months pregnant. I did however clean the room and wash the laundry, so technically I did my job. I have been an employee at this facility for a year and a half with no write ups or call offs. Do I have any rights? Please help.

Dear Madam:

You might have a claim as it sounds to me that there were other individuals that were responsible for this task but your employer elected to request you to do something to either put you in a demeaning situation or to create a pretext for your termination. I would have to know more about the whole incident and your past relationship but from your indication you may be a victim of employment discrimination.

You should seek the services of a competent attorney who on more thorough examination can determine the strength of your claim.

Should you need further information you can contact my office for a free consultation.

Sincerely yours,

Daniel Lenghea
