Keeping track of hours
I have forgotten to punch out at the
end of the day a few times, and my
employer claims that he does not
have to pay me for the hours. I
keep track of all my hours and tips.
Can my pay really be withheld
because I forgot to clock out

As a non-exempt employee, you are entitled to be paid the minimum wage for all hours worked, and to the extent your employer claims a tip credit, that might be reduced but you are still entitled to compensation for the hours you worked. You should consider putting a request in writing for payment to your employer and if they still have not paid you, you may want to explore consulting a lawyer.
