Legal Overtime -- Weekly Hours Worked

IS an employer allowed to pay hourly employees overtime only after completing 45 regular hours per week? In other words, is it legal to deny overtime after an employee completes 40 hours in one week and is designated on hourly pay?

Overtime pay is required for non-exempt employees after 40 hours in a workweek. However, there are some employer-friendly methods to meet that overtime obligation in a way that does not appear to comply on the surface. The details of the pay scheme in question would have to be analyzed.
