Can I lose my Full time status and pay?

When I came back from a leave of absence do to a work related injury, I was told that I would no longer be a full-time employee and my salary was cut in half and I lost all of my benefits. I was told this was do to down-sizing, except that I was the only one it was done to. Is this legal? What are my rights?

Your question cannot be answered with a simple yes or no. There are several laws, both state and federal, that provide protection for workers such as yourself. However, to determine if you are covered I would like to know more about the company that employs you. How many employees are there? How long have you worked there? How long were you absent from work? Are you able to return to work without any restrictions? As you see your question is a bit more complex that at first it might seem. consider the possibility that this is "retaliation for your workers' compensation status"... there is a provision in florida law on this...consult with a workers compensation atty. There is caselaw under that statute. however, the actions taken by your employer might have been for a different reason. therefore, the prior atty reply is well founded.. Consult counsel promptly, preserve the evidence!
