non compete clause
my wife was fired because the company she worked for could not meet payroll, can they hold her to a non compete

DId they pay her what they owed her before termination? Depends also upon the terms of the noncompete. I have defeated many non-competes. Feel free to call and discuss further.

The answer is MAYBE. The language of the non-compete will be helpful in determining. An attorney should be able to advise you relatively quickly if the clause is enforceable.
You could also request a release from the non-compete given the reason for her termination. Get it in writing from someone in a position of true authority within the company or even their counsel.
