Non-Compete
The company that I work for lost the contract to provide services at the hospital where I work. The new company wants to hire me, but I have a non-compete. My present company said that there is no room to absorb me into any other account in the area, and my boss and the VP suggested that I contact the new company for future employment. They also said that issuing a waiver of my non compete ''SHOULDN'T BE A PROBLEM''. The new company offered me a similar but significantly higher paying position. My present company has now changed their mind and said that they will enforce non-competes. To further protect themselves, they are willing to keep me at another local account, at my present salary. Is there anything that I can do since that I was not the cause of the loss of the contract, and by restricting me from taking the position, it prevents me from career enhancement and a significant salary increase. Your non-compete may not be enforceable and/or may not legally prohibit you from working for the other employer even if it is legally enforceable.
