non-compete

I was laid off from a high level managment job with lots of client contact. Is my non-compete voided?

Also I was presented with it after they moved me here from out of state. Is that a factor in enforcement?

Thirdly I signed the separation agreement. It was non mentioned in it. Does that weaken the company's ability to enforce?

Too many questions to answer without reference to your documents. What does your noncompete say. Normally, whether you quit or oare fired the non-compete still applies but there are many defefnses to enforcement. The lanagugage of the severance agreemeent will determine whether or not they releasesed you from the noncompete. Call or e-mail me to discuss further.

The law surrounding non-compete agreements is very complicated, and it depends on the particular circumstances of each case. For example, it depends on the length of time of the restraint, as well as the geographic scope. The fact that the separation agreement does not mention is a factor that weighs in your favor, however it is not dispositive.
