Legal Question in Employment Law in Florida

Obligation of employer for last check for days worked.

I recently resigned along with 9 other employees from a local company. We resigned on the 24th and the next pay day was to be the 1st. I heard a rumor that the employer was planning not to pay the last paycheck to the employees? Is that legal? The employees worked full work days up until their resignation date? They were last paid on the 15th.

Also what are the laws in Florida regarding being paid for unused accrued vacation pay?

One other employee was fired, as per his employment agreement he is due a severance check? Are there laws regarding severance? Should the employee pursue a remedy? If so then who with? Is there a state department that handles that? Or does the employee need to sue the employer?

Employees should be paid all wages owed. Employer should pay vacation, but depends upon company policy in manuals, etc. As to the severance issue, I would need to see the contract. There is not requirement that severance be paid in Florida. Call me if you have questions. (954) 385-5433.
