Legal Question in Employment Law in Florida

Order to remove resume from job site

My boss saw my resume on a job site and asked me about it. I verified that it was my resume and that I updated it regularly. The next day he called me into his office and told me I had 30 days to remove my resume from the job site or I would be terminated. Do I have an legal course.

Re: Order to remove resume from job site

The short answer is no if you are an "at will" employee. Approximately 98% of employees in Florida are considered to be "at will" employees. That means that you basically can be fired for any reason as long as they are not firing you due to your race, religion, gender, age, disability, etc. So, yes they can fire you for posting a resume online on a job website. Also, it is commonly accepted that getting caught search for a new job by your current employer is grounds for termination. It's kind of like showing up to work drunk-- it's grounds for immediate firing. So if I were you, I would take the resume down immediately and apologize to your boss. You certainly have no grounds for an employment lawsuit.

Nope -- emplopyers generally don't like their employees advertizing to be hired away from them.
