Legal Question in Employment Law in Florida

Overpayment in Health benefits

I have health benefits which are paid by me, each pay period. Somehow in each health benefit paid, the company has an negative figure which gives me extra pay for that benefit. I have called payroll and written several times addressing this mistake. I assume it would get corrected at the times I have inquired of this overpayment. How long can a company go back in the state of Florida and try to recover this overpayment of health benefits, resulting in a bigger paycheck? I have alerted them to this mistake many times and it still goes on.

Keep good records that you have advised them.

Make sure you have advised them in writing.

Go and see someone.

They can come back for a few years I am sure, so just set the extra money aside until they tell you affirmatively that you do not owe them anything. Don't spend it. I would go and see someone about this and get it resolved one way or the other, in writing.
