Overtime

Dear Sirs or Madams:

Are Churchs excempt from having to pay overtime wages?

And is it legal for an employer to make an employee work overtime and only get paid straight time?

Churches are not exempt. However it is unlikely a typical church would pass the threshold test for coverage under the FLSA: be an enterprise engaged in commerce with revenues of $500,000 annually, or have employees engaged in commerce.

However, it should be decided on a case by case basis.
