Legal Question in Employment Law in Florida
I am partner and salaried employee of a consulting firm. We are working on an buyout/resignation agreement but have not come to any terms. My paychecks are paid every two weeks, but my partner/employer is withholding my normal salary paycheck normally paid on the 15th because of the pending agreement.
Can they do that, and what steps can I take to claim that amount? Our employement agreement states they can terminate with or without cause, but must give 60 days notice for termination without cause and pay all normal salary during that period, and i have 10 days to resolve termination with cause notice. Please advise.

I would have to look at contract, but I would say they need to pay you as scheduled. You can hire a lawyer to send thme a demand letter or possibly go to the US Dept of Labor and complain you have not been paid. Feel free to e-mail or call me to discuss further. [email protected]
