Legal Question in Employment Law in Florida

Pay adjustment

Dear Lawguru,

Can an employer in Florida at a tella-marketing business legally reduse your pay two dollars per hour, for the entire week if you are late one minute one day that week, and an additional $2 per hour if you are late a second time that week ? I was given a slip saying ''if I did not complete a full shift this would happen. I had a doctors slip on this ocassion and I was told I could only it for one day, not the 2 days I missed, and had doctors slips for. None of this NEW information is in writing and i was told its the company policy.

Thank You,

Re: Pay adjustment

Well, it depends on many factors, including how much they pay you and if it would fall below Florida or Federal minimum wage. The general answer is no, an employer is ordinarily not allowed to withold salary because you were late on another time. Unless your employer's policies provide otherwise, you could be terminated for this at any time, or for no reason at all, but that is another story.
